One year anniversary of Arrest Video.

Today marks the one year anniversary of the arrest of Paul Pechonis, one must wonder are we safer as a society. After all isn’t the main purpose of law enforcement, to make our society safe.

In 1999, Bonuskill@eartlink.net was chosen after Mr. Pechonis failed to qualify for a Christmas bonus at his job based on the lack of one day of employment.

As bonus rhymed with Pechonis it soon became a favored nickname by his fellow employees.

The web site was later designed as a learning experience and to show pictures of his family. The site averaged less than 25 hits a week.

The issues in question began for Mr. Pechonis in 2004 due to a threat issued by Marlborough Police Officer James Gough, to kill his son. An internal investigation agreed Officer Gough had violated Marlborough Police regulations by his actions. Mr. Pechonis however was denied knowledge of the actual discipline received by Officer Gough.

Mr. Pechonis later complained about a Judicial ruling over a credit card debt, an issue recently exposed by the Boston Globe called Debtors' Hell, as inflicting many unfair rulings.

Mr. Pechonis never knew or met any of the individuals he was accused of threatening by written words on the internet.

When Mr. Pechonis first contacted the conte2006.com web site he was fearful that the site was associated with the District Attorney.  Lacking in trust he first released the video on the internet via the decoding a rhyme he had written on his site Bonuskill.com

When you look at all the time spent and funds expended by the District Attorneys in Worcester and Middlesex Counties. The means certainly fails to justify the end. 

All misdemeanor charges against Mr. Pechonis are to be dismissed without a finding in 2007.

The inadvertent ‘nanny cam” taping of Mr. Pechonis's arrest demonstrates the ability of the Massachusetts State Police assigned to Worcester District Attorney John Conte to disregard our constitutional protection with little fear of recourse.

Why has Massachusetts Attorney General Thomas Reilly over looked the illegal search? 

Our founding Fathers died for this county so each man could live free.

The First Amendment is first because they believed free speech was the most important right of living in a free nation.

Sadly, each and every person who lives in Massachusetts lost a piece of their constitutionally protected rights on September 29. 2005.

Internet threat charges could be dismissed

MARLBORO— Charges against a Northboro man accused of threatening a Marlboro police officer on a Web site could be dismissed if the man abides by conditions set by a Marlboro District Court judge.

A Worcester Central District Court judge last month also agreed to dismiss charges against the same man for similarly threatening a Westboro District Court judge.

Paul T. Pechonis, 47, of 17 Milk Porridge Circle, Northboro, was arraigned in Marlboro District Court in February on a charge of threatening to commit a crime (murder) against Marlboro Police Officer James P. Gough. He allegedly posted photos of himself carrying weapons and the words “Death to Pig Gough” on a Web site, which police records say created by Mr. Pechonis.

According to court records, Judge Douglas W. Stoddard on June 9 continued the case without a finding for nine months and ordered unsupervised probation for Mr. Pechonis. He was also ordered to have no contact with the officer or the Marlboro Police Department and take any references to the department or Officer Gough off the Web site. He was also ordered to pay a $50 victim witness fee.

According to a police report, the Marlboro Police Department became aware of the Web site in early September after Mr. Pechonis allegedly sent a link to the site, which contained the threat against Officer Gough, via e-mail to Police Chief Mark F. Leonard.

The report said Mr. Pechonis subsequently told Marlboro Police Capt. Paul Valianti during a phone conversation that “he took the stuff down, and it was a joke, and he did not mean anyone any harm.”

Mr. Pechonis also allegedly told Capt. Valianti he has no issue with Officer Gough other than that he had threatened his son’s life. According to a citizen complaint of police misconduct filed last July by Mr. Pechonis’ son, Jared Pechonis, the young man was pulled over by Officer Gough and said he felt threatened and harassed by the police officer.

In the Worcester Central District Court case, Mr. Pechonis allegedly called for the “resignation or execution” of Westboro District Court’s presiding justice, Paul S. Waickowski, on another Web site also allegedly created by him.

According to court records related to that case, one of the Web sites made references to a Westboro District Court civil hearing in which Mr. Pechonis’ paycheck was garnisheed for money owed to a credit card account. According to the records, Mr. Pechonis allegedly blamed Judge Waickowski for the order, but state police investigators found it was Judge Vito A. Virzi who presided over the case.

Worcester Central District Court Judge William P. Hadley on May 1 continued the case without a finding for a year and ordered Mr. Pechonis to have no contact with the victim or the victim’s family and to pay a $50 victim witness fee.

Agreement to remove material on website in reference to Marlborough Police Department will resultant in charges being dismissed.

After almost two years of a legal struggle to seek protection for his teenage son and receive accountability for the actions associated with Marlborough Police office James P Gough. 

Father and webmaster Paul Pechonis of the Bonuskill.com website has had his criminal charges in Marlborough district court continued for dismissal by District Court Judge Douglas Stoddart. 

Mr. Pechonis’s Attorney, Randy Power arranged a plea agreement to dismiss criminal charges of threat to commit a crime, murder if Mr. Pechonis agreed to the removal of all material in reference to the Marlborough Police department from his website Bonuskill.com, nine and a half months unsupervised probations and a fifty dollars victim witness fee. 

Judge Stoddart allowed Mr. Pechonis one week to remove all material from the Bonuskill.com web site. 

A March 12, 2007 date is set if all stipulations are completed without incident, the criminal charges will be dismissed without a finding. 

The Web site page in question was titled, “Death to Pig Gough” according to police a picture of a man holding and pointing a shotgun, sword, revolver and a handgun at the camera.  

On September 21, Mr. Pechonis was first charged for allegedly asking for the “resignation or execution” of Westboro District Court Judge Paul S. Waickowski on one of the Web sites he created with threatening to commit a crime (murder). 

Mr. Pechonis allegedly placed a poster of his child and that statement on a bulletin board in the Westboro District Court hallway Sept. 9, according to court records.   

On November 11, 2005, Mr. Pechonis received an application for criminal complaint from Marlborough district court, for the offense of MGL 275/2, threat to Commit Crime, offense date, September 13, 2005.  

A probable cause hearing on this complaint occurred December 8, 2005.  The complainant name was Captain Paul Valianti, who is listed on the Marlborough Police Department, as Services Division Commander – Internal Affairs. 

Captain Valianti, was the Marlborough Police internal affairs officer that Mr. Pechonis had dealt with concerning the actions of Police Officer James Gough who allegedly made threats to kill his teenage son.  

On January 8, 2006 Mr. Pechonis’ lawyer and the assistant district attorney had agreed to $500 bail and a lengthy list of conditions for the suspect’s release, Marlborough district court Judge Thomas Sullivan rejected the agreement and set bail at $20,000. 

On March 7, 2006 Mr. Pechonis had his $20,000 bail reduced to $5,000. 

On May 7, 2006 in Worcester District court the threat to commit a crime, murder charges ended in a mutual agreement by Worcester ADA Harold Johnson of one year’s unsupervised probation with an agreement to stay away from Judge Paul S. Waickowski, Judge Vito A. Virzi and their families. 

Mr. Pechonis will now have his $5,000 bail returned from Marlborough district court.

Mr. Pechonis stated today in a telephone interview “I have been prosecuted and persecuted by the legal system. I believe these charges are in violation of my first amendment rights; in addition I was subject to what I perceive as excessive representation of force by the Massachusetts state police assigned to Worcester District Attorney John Conte’s Office”.  

Mr. Pechonis arrest by the State police Trooper Nick Nason, was later discovered on a baby cam and provided to the conte2006.com web site.  That video is now the subject of a Federal Preliminary injunction allowing the video to be played without fear of prosecution from District Attorney John Conte.  Currently the State of Massachusetts has appealed the injunction ruling. 

Mr. Pechonis went on to say “a deal is a deal and I will remove all reference to the Marlborough police department and Office James P. Gough as required”.  After March 12, 2007, Mr. Pechonis will be free to publish any material on his website.

Web threat case ends with charges dismissed in a year.

A scheduled Monday, May 1st hearing on motion to dismiss misdemeanor charges, threat to commit a crime, murder in the case of Northborough's Paul Pechonis, ends as continued without a finding, charges to be dismissed in one year.

The threat to commit a crime, murder charges ended in a mutual agreement of one years unsupervised probation with an agreement to stay away from Judge Paul S. WaickowskiJudge Vito A. Virzi and their families.  

A twenty-one dollar per month administrative fee was assigned by Judge William Hadley. 

Mr. Pechoins said “ I only agreed to the conditions to alleviate the terrible emotional and financial strain on my family”. 

Mr. Pechonis does not consider this a good deal, and feels he has not broken any laws.  Mr. Pechonis feels he has been victimized.  

The original arrest warrant that was flashed by Trooper Nicholas E Nason, which can be viewed on video has never been seen by Mr. Pehconis.  

Arresting State trooper, Nason was present in Worcester District Court on Monday and was seen carrying an eight inch folder with the name Pechonis hand written on the cover. 

The original color poster in question has never been produced by Worcester District Attorney John Conte’s office. Only a copied black and white version has ever been seen.  In addition no explanation has ever been provided as to how the wording appeared on the poster once it was inside the Westborough District court building.  

Mr. Pechonis had no prior relationship with either judge, the entrance lobby tapes in Westborough district court were not provided in discovery.  No fingerprints from the poster were ever provided in court. Mr. Pechonis denies that the baby on the poster is his, and feels the poster looks like the Gerber baby.     

Mr. Pechonis called the Telegram city desk three different times beginning early Monday morning and spoke with a gentleman named Mike, who stated that Telegram court reporter Gary Murray was present in courthouse and his case and was on a list to be covered.  

Mr. Pechonis was never approached for an interview on Monday. The Telegram has had extensive coverage of the charges being filed, yet failed to cover the disposition of the case.   Mr. Pechonis said in an interview “ I believe District Attorney Conte suppressed the coverage of the story”.  

The only media coverage was in the MetroWest daily news who buried the story on the second page of the local section.  Mr. Pechonis feel the MetroWest has demonized him and slandered his good name.  Mr. Pechonis has said that he will seek a correction.  

Viewed on the now well publicized video are the Massachusetts State Police Unit assigned to District Attorney John Conte making a rather heavy handed arrest, of what appear to be a very calm and unarmed man.  Mr. Pechonis who is seen on the video standing still and not moving is then subjected to what many have suggested appears as a search of his home without a warrant.   

The political prosecution of Mr. Pechonis continues.  Mr. Pechoins still faces charges for threat to  commit a crime, murder in Marlborough District court.

Mr. Pechoins contends he has never met Marlborough Police Officer James Gough.

Threat suspect gets no jail time

WORCESTER -- A Northborough man charged with threatening to execute a Westborough District Court judge will have his case dismissed provided he keeps his distance from two judges over the next year. 

Milk Porridge Drive resident Paul Pechonis, 47, allegedly called for the "resignation or execution of Judge Paul S. Waickowski" on the Web. According to court records, the threat was in retaliation for Waickowski's various decisions against Pechonis and his son, Jared Pechonis.  

Pechonis' case was heard in Worcester District Court on Monday. Pechonis agreed "sufficient facts" were true in the case and received a continuance without a finding. He is required to check in with a probation officer for a year and to stay away from Waickowski and his family and Judge Vito A. Virzi and his family. 

 "I don't really consider this justice because I didn't break any laws," Pechonis said in a phone interview this week. "I didn't really do anything wrong." 

 According to prosecutors, Pechonis made threatening remarks on two Web sites, the now-defunct www.howardleeschiffpredators.com and www.bonuskill.com. Pechonis also alleged that Waickowski was responsible for imposing a $500 cash bail when his son was arrested. And Pechonis also complained on the Web that Waickowski "sentenced" him to attend two Alcoholics Anonymous meetings a week after Pechonis told a woman to leave him alone. 

Pechonis also allegedly blamed Waickowski for a civil case in which his wages were garnished to pay a credit card debt. Police said Pechonis blamed the decision for starving his family. Pechonis posted a picture of his baby at the Westborough courthouse with the words "Judge Paul S. Waickowski is slowly starving my baby to death." 

However, Pechonis was apparently confused, the judge in that case was Virzi.

Breaking News: Today in Worcester District Court, Worcester ADA Harold Johnson states "the Government wants Paul Pechonis to turn in original copy of arrest video".

Mr. Pechonis via legal counsel Paul Padula refused stating "the tape is an unrealistic request".

Motions to dismiss to be filed by defendant, due on April 18, next court appearance May 1, in Worcester District Court, trial date to be set.

Hearing appeal against Officer James Gough, in Marlborough District court, Friday April 7, 2006.

Jared Pechonis of Northborough has filed with Marlborough District court to have his denied application for criminal complaint appealed to a Justice of the court. A hearing will occur on Friday April 7, at 10am.

Mr. Pechonis’s criminal complaint application against Officer Gough, for threats to commit a crime was denied by Paul F. Malloy, clerk of Marlborough district court without a hearing.

Mr. Pechonis's citizen complaint in reference to the threat by Officer Gough to place his gun against his head was investigated previously by the Marlborough Police department.  Mr. Pechonis was informed on August 11, 2005 by Captain Timothy J. Naze, that Officer Gough was found to have violated the department rules and regulations.  It further stated that he be subject to appropriated disciple under the agency's procedures.   

The failure to deal with the actions of Officer James Gough correctly by the Marlborough Police department remains the underlying factor to the “arrest video” which currently awaits a ruling by US District Court Judge Fredrick Saylor IV. 

The amount of tax payer’s time, money and effort relating to the numerous court actions, revels to what extent District Attorney John Conte will go to for his political prosecutions.

Bail reduced for man accused of Internet death threats

The Northborough man accused of making death threats against a Marlborough cop on a Web site had his $20,000 bail reduced to $5,000.  

Paul Pechonis, 47, of 17 Milk Porridge Drive appeared last month before Marlborough District Court Judge Thomas Sullivan on one count of threatening to commit a crime, a misdemeanor. Sullivan had set bail at $20,000 because the alleged threat was a murder threat, and Pechonis posted bail after his Feb. 8 arraignment.  

He petitioned for reduced bail at a hearing Monday in Middlesex Superior Court in Cambridge, and had bail cut to $5,000, with $50,000 in sufficient sureties, according to a court document.  

Pechonis allegedly threatened to kill Marlborough Police Officer James Gough by posting "Death to Pig Gough" on his Web site, www.bonuskill.com, according to court records. He is also alleged to have posted a threat online against Westborough District Court Judge Paul Waickowski.  

His Sept. 29 arrest, which he said was without a warrant, was caught on tape by a nanny-cam in his home. That video is displayed on the Web site, www.conte2006.com, which Mary T. Jean of Leominster runs. The site displays several links, articles and ideas on retiring Worcester County District Attorney John Conte.  

State police had issued a cease and desist letter to Jean. However, a U.S. District Court judge in Worcester issued a temporary restraining order Feb. 17, prohibiting state police from taking action against Jean. The restraining order is in effect until April 7. Jean’s next court hearing is set for March 30.  

Pechonis also received a cease and desist letter on Feb. 23 from the state police to take down the link alerting viewers of his site, www.bonuskill.com, to go to www.conte2006.com, where they can watch the video of the arrest. The letter, dated Feb. 14, ordered Pechonis to remove the link within 48 hours of receipt of the letter.  

He said he has no comment about whether he removed the links from his site. "I don’t claim full responsibility (for the Web site), nor have I admitted it’s mine," he said yesterday. Pechonis said he also might consider taking out a restraining order against the state police.  

"I just don’t see how they can prosecute me for having a link to the site," he said. "If they go after me, they have to go after the entire World Wide Web. If this is a violation of the law, pretty much everybody on the Web would have to be arrested," he said, noting that news outlets and blogs have links to www.conte2006.com.  

"They’re telling me it’s illegal to put a link on the site. It’s ludicrous," he said. Pechonis’ next hearing in Marlborough District Court is scheduled for April 7.  

Also, a case involving Pechonis’ 20-year-old son, Jared Pechonis, was dismissed Feb. 2, according to a letter signed by Marlborough District Court Clerk Magistrate Paul F. Malloy.

Jared had filed a complaint with the Marlborough Police Department, alleging that Gough threatened to put a gun to his head during a traffic stop in June, and requested a formal court hearing.  

"The alleged statement of the Officer did not constitute an imminent threat to you and were merely words of warning by the Officer that if you failed to comply with the lawful instructions of the Police Officer in the future, the Officer may draw his weapon for his own protection," Malloy wrote in the dismissal letter.  

Marlborough Police conducted an investigation this summer, and disciplined Gough for violating department rules and regulations. A letter dated Aug. 11, signed by Marlborough Police Capt. Timothy J. Naze, said Gough was disciplined, but it didn’t say how.  

"None of this would be going on if I hadn’t starting communicating with the Marlborough Police on the harassment of my son by Officer Gough," Pechonis said. "It’s just vendetta, that’s what it is all about."

Threat charge is no joke

MARLBOROUGH -- A Northborough man charged with making online death threats against a Marlborough Police officer and a judge was released yesterday, but only after a Marlborough District Court judge dramatically increased his bail.

Paul Pechonis, 46, of 17 Milk Porridge Drive, was arraigned on one count of threatening to commit a crime. The charge stems from threats he allegedly made online to a police officer who had been involved in a dispute with his son over a traffic stop last summer.

While Pechonis’ lawyer and the assistant district attorney had agreed to $500 bail and a lengthy list of conditions for the suspect’s release, Judge Thomas Sullivan rejected the agreement and set bail at $20,000. The misdemeanor charge of threatening to commit a crime carries a maximum sentence of six months in jail and $100 in fines.

Middlesex Assistant District Attorney Dan Belger told Judge Sullivan the state was content with $500 bail and a list of 87 conditions for Pechonis’ release, but the conversation ended when the judge insisted on a much higher bail.

"This is certainly a very serious matter," Sullivan said. "You understand, I’m considering much more than that."

Defense lawyer David Kapelner said Pechonis should be presumed innocent. "He is charged with threatening to commit a crime. It’s a misdemeanor. This is an arraignment," Kapelner said.

"The crime is murder...it’s threatening to commit the crime of murder," Sullivan said, adding that Pechonis also faces the same charge for threatening a Westborough District Court judge.

After the hearing, Pechonis said he expected Sullivan to be harsh on him. He claimed he’s the victim of a conspiracy.

According to court records, after being questioned by Marlborough detectives, Pechonis admitted to posting threats online. He called the comments jokes.

Pechonis said yesterday he stands behind his First Amendment right to free speech.

Pechonis claims Marlborough Police Officer James Gough threatened to put a gun to his son Jared’s head last summer during a traffic stop. After that, Pechonis claims Gough followed his son around the city, harassing him. Jared Pechonis and his father both reported the alleged incident to Marlborough Police Chief Mark Leonard and submitted written statements to back up their claims.

Leonard said yesterday an internal investigation determined Gough never held a gun to Jared Pechonis’ head. Leonard wouldn’t elaborate on the specifics of the probe, but he said the Pechonis’ concerns were addressed and the investigation was complete.

Soon after that, death threats against Gough showed up on a Web site registered to Paul Pechonis. He ran four Web sites, many with anti-police billboards, according to court records. One of the threats read, "Death to Pig Gough."

According to court records, in complaining about Gough to Leonard, Paul Pechonis inadvertently sent Leonard the Web site link that contained the threats against Gough, complete with pictures of Pechonis holding guns and the threats against Gough posted above his head.

On the same Web site was a death threat against Westborough District Court Judge Paul Waickowski.

Once police got wind of the threats, the Middlesex district attorney’s office and state police detectives began investigating.

Pechonis’ lawyer argued against higher bail yesterday.

"He denies the allegations...he would need an opportunity to present his case," Kapelner said. "This is a misdemeanor charge."

Sullivan was not swayed.

"I’m not going to treat this in a minor fashion...not on my watch," Sullivan said. "I’m not going to have someone walk out the door with bail we would set on a shoplifting case."

Pechonis eventually posted bail and is scheduled to return to court on Feb. 24.

MARLBORO— The Northboro man facing charges in Worcester Central District Court after allegedly threatening a judge was released yesterday on $20,000 cash bail set by a Marlboro District Court judge, where he is accused of similarly threatening a police officer.

Paul T. Pechonis, 46, of 17 Milk Porridge Circle, Northboro, was arraigned in Marlboro District Court yesterday on a charge of threatening to commit a crime (murder) against Marlboro Police Officer James P. Gough. He allegedly posted photos of himself carrying weapons and the words “Death to Pig Gough” on a Web site, which according to police records was authored by Mr. Pechonis.

In a pending case in Worcester, Mr. Pechonis is alleged to have called for the “resignation or execution” of Westboro District Court’s presiding justice, Paul S. Waickowski, on another Web site also allegedly authored by him.

Before bail was set yesterday, Mr. Pechonis said outside the courtroom that he denies “being the author of any and all of those things,” and that “it’s a question of access,” explaining others have access to the Web sites.

Mr. Pechonis had filed a motion to dismiss before his arraignment, citing several reasons, including that the Web site cannot be proved to be his and that the thoughts expressed on the site are not threats. Judge Thomas F. Sullivan Jr. said he could not file such a motion before an arraignment and advised him to let his lawyer know about the motion.

Mr. Pechonis was represented yesterday by court-appointed lawyer David Kapelner, but said he would hire Peter E. Padula, the same lawyer representing him in the Worcester case, for the more recent case.

Assistant Middlesex District Attorney David C. Belger recommended bail be set at $500, citing what he said was Mr. Pechonis’ three-page criminal record and two restraining orders. He recommended Mr. Pechonis be ordered to surrender any firearms, stay away from Officer Gough, not be allowed to have any firearms or weapons, not commit any federal, state or local crime, and refrain from use of alcohol and drugs. According to court documents, threatening to commit a crime is considered a misdemeanor.

Mr. Kapelner said he agreed with the $500 cash bail, but Judge Sullivan said he was “considering much more than that,” stating he was concerned with the facts and calling the matter “serious business.”

According to a police report, the Marlboro Police Department became aware of one of the Web sites in early September after Mr. Pechonis allegedly sent a link to the site, which contained the threat against Officer Gough, via e-mail to Police Chief Mark F. Leonard.

According to the report, Mr. Pechonis told Marlboro Police Capt. Paul Valianti during a Sept. 16 phone conversation that “he took the stuff down and it was a joke and he did not mean anyone any harm.”

After coming to the police station for an interview the same day, Mr. Pechonis allegedly said he posted some of the content on the Web site, including pictures of his family and pages with humorous content, according to the report. He also allegedly said he posted material about Officer Gough and that it was intended to be a joke. Mr. Pechonis also allegedly told police the guns in the pictures were not real.

Mr. Pechonis, who yesterday offered business cards featuring the Web site’s address, also allegedly told Capt. Valianti he has no issue with Officer Gough other than that he threatened his son’s life.

According to a citizen complaint of police misconduct form filed July 8 by Mr. Pechonis’ son, Jared Pechonis, the young man was pulled over by Officer Gough and said he felt threatened and harassed by the police officer.

Jared Pechonis also wrote in the complaint he was pulled over six weeks before for no reason and that the police officer, whom he believed to be Officer Gough, said he would put a gun to his head if he did not have his hands on the wheel and look forward if he was to be pulled over again by the officer.

According to court documents, Mr. Pechonis allegedly sent several e-mails to Chief Leonard asking him to look into the matter regarding his son’s complaint and containing the link to the Web site.

Capt. Valianti wrote in his report that based on Mr. Pechonis’ statements during the September interview, “it is clear that he is trying to threaten Officer James Gough through this Web site. The threat was clearly communicated through his e-mails to the Chief of Police … The words alone are themselves threatening. However, coupled with photos of him holding what appears to be firearms and edged weapons along with threats to kill Officer Gough, his intent is clear.”

During yesterday’s arraignment, Mr. Kapelner argued that Mr. Pechonis had already posted bail on charges stemming from similar circumstances, and that the two cases may be consolidated at some time and be handled in Worcester. Mr. Pechonis was released on $5,000 cash bail after arraignment in Westboro District Court on the charge he threatened to murder Judge Waickowski before his case was continued to Central District Court.

According to court records related to that case, one of the Web sites made references to a Westboro District Court civil hearing in which Mr. Pechonis’ paycheck was garnisheed for money owed to a credit card account. According to the records, Mr. Pechonis allegedly blamed Judge Waickowski for the order, but state police investigators found it was Judge Vito A. Virzi who presided over the case.

Mr. Kapelner yesterday asked for a “reasonable amount of bail,” adding that Mr. Pechonis has no firearms, does not drink alcohol and would be able to adhere to all the conditions recommended by Mr. Belger.

After bail was set at $20,000, Mr. Pechonis said after the arraignment, “It’s a misdemeanor and an outrage.” The case was continued to Feb. 24.

Marlborough Judge, Thomas F. Sullivan Jr. places astronomical bail for misdemeanor charge. 

Web threat defendant Paul Pechonis was held over for a bail hearing in Marlborough District Court by Judge Thomas F Sullivan Jr. at 2pm today. Assistant Middlesex District Attorney David C. Belger  had agreed on $500.00 bail however Judge Sullivan refused to hear bail during the arraignment this morning for the misdemeanor change of threat to commit a crime.  

Judge Thomas F Sullivan Jr. during a 3:45pm end of the day hearing set bail at $20,000.

Mandatory weekly drug testing, a surrender all weapons, and a stay away order from Officer James Gough, and the Marlborough police department were also ordered by Judge Sullivan as additional conditions.

Mr. Pechonis posted bail. 

According to Edward P. Ryan, Jr. Chairman, Massachusetts Bar Association Committee on Judicial Independence. Bail is not supposed to be used as a punitive measure and can't be used for preventative detention unless the defendant is proven to be dangerous and a flight risk after a hearing that has been requested by the prosecutor.  The purpose of bail is to insure that a person will appear in court when required to do so.

The alleged threat took place in July 2005, now some seven month later Judge Sullivan attempts to have Mr. Pechonis held on high bail.

Mr. Pechonis defense lawyer lawyer David Kapelner, continued to inform Judge Sullivan that he had a deal with Assistant Middlesex District Attorney David C. Belger for bail of $500.00 dollars. 

Press Spokesperson Ms Emily Lagrassa who was reached for  comment stated she would contact Marlborough District Court for clarification and call back with information.  Several additional calls were placed after bail hearing and Ms Lagrassa remained unavailable for comment.

The failure of Ms Cokley to answer the questions placed concerning this case only leads to further speculations that "judicial bias " concerning Mr. Pechonis occurred.

Judge Sullivan's application of this high bail not only shows judicial misconduct but represents the very core of "judicial failure" that has been allowed breed within our court hallways for some time now. 

Judge Sullivan's decisions appear to be based on social standing rather than actions.

June 7, 2005, Judge Sullivan overturned the state's decision to revoke the pension of Francis X. Lambert, a former Hudson public school teacher who was convicted on child pornography charges.

March 5, 2005, A Hudson police officer was arraigned in Marlboro District Court on a charge of filing a false report by a public employee. He was released on personal recognizance by Judge Sullivan.

Marlborough Police Chief Mark Leonard, in phone conversation today stated he had no knowledge of his Officers being at the bail hearing, or if they were in attendance in support of Officer Gough.  Chief Leonard suggested the men may be Massachusetts State Troopers.

These latest charges were field by Marlborough police Captain Paul Valinati by claiming Mr. Paul Pechonis on diverse dates hosted a web site in which he threatened the crime of murder against officer James P. Gough of Marlborough police department. 

Mr. Jared Pechonis has initiated an application for a criminal complaint against Marlborough Police Officer James Gough for threatening to commit a crime (murder).  A hearing date has been set for February 16, 2006. 

Mr. Pechonis's citizen complaint in reference to the threat by Officer Gough to place his gun against his head was investigated previously by the Marlborough Police department.  Mr. Pechonis was informed on August 11, 2005 by Captain Timothy J. Naze, that Officer Gough was found to have violated the department rules and regulations.  It further stated that he be subject to appropriated disciple under the agency's  procedures.  

The excessive amount of tax payers money and Judicial court time wasted on this frivolous charges placed against Mr. Pechonis based on wording on a web site is perplexing.

Mr. Pechonis has filed for a bail reduction hearing.

DA Conte's Massachusetts State Police C-Pac unit arrest in web threat criminal case shown on video.
Officer James Gough to face clerk on criminal complaint application for threatening to commit a crime (murder).  

Unbeknown to the Massachusetts State Police Detectives as they arrived in twelve (12) different police vehicles, with troopers dressed in black clothing armed with semi-automatic rifles running flank around the home, taping of their arrival occurred.  

Massachusetts State Trooper Nicholas Nason had called earlier and asked if he could come over to speak with Mr. Pechonis.  

Mr. Pechonis was not expecting the aggressive assault upon his family found after he had returned home from his late afternoon arraignment in an almost empty Westborough District Court.  A complete video copy of the interaction with the State Police, their search of his home without a warrant, and his arrest which had been previously described as to contain numerous misleading statements by Trooper Nason. 

Mr. Pechonis who was overwhelmed by the confrontational arrival at his home basically stood motionless just asking "what crime am I being charged with?"  

The five (5) minute video captures seven Massachusetts State Police detectives, who claim they are searching the house for their own safety because there are weapons involved, walking in circles with their hands in their pockets, heads looking down, on a causal stroll pace.   

Sgt. Francis Leahy can be seen going upstairs to the location of a sleeping baby, and he was followed by Mrs. Pechonis. Mrs. Pechonis was not allowed into her bedroom while Sgt. Leahy searched with the door closed.   

No search warrant has ever been produced by the Massachusetts State Police or by Worcester District Attorney John J. Conte for the Pechonis residence.  

In other actions concerning this case,  Mr. Jared Pechonis has initiated an application for a criminal complaint against Marlborough Police Officer James Gough for threatening to commit a crime (murder).  A hearing date has been set for February 16, 2006.

Police officer faced discipline after complaint

A Marlborough Police officer was disciplined this summer for violating department rules and regulations during the traffic stop of a Northborough teen.

A letter dated Aug. 11, signed by Marlborough Police Capt. Timothy J. Naze, an operations division commander, said Officer James Gough was disciplined. The letter did not reveal the nature of the discipline.
The letter was a response to a citizen complaint of police misconduct filed by 19-year-old Jared Pechonis. His handwritten complaint was filed July 8, according to the letter.

in the letter addressed to Pechonis, Naze stated the teen’s complaint was investigated by Gough’s immediate supervisor and reviewed by himself.

"The investigation revealed that Officer James Gough violated departmental rules and regulations," the letter stated. "He will be subject to appropriate discipline under our agency’s procedures."
"This complaint has been resolved by the division command level and a copy of your complaint and this letter will be placed on file," the letter stated.
In the complaint, Pechonis said Gough pulled him over at about 2 a.m. after he drove some friends home from a concert.

He said he asked why he was pulled over and the officer replied, "’because I don’t want you driving in my (expletive) city."’

Pechonis said he "felt harassed and threatened. ... Officer (Gough) was rude and completely out of line."
    In the complaint, the teen said six weeks prior to the July incident, an officer had pulled him over. He did not say which officer. Pechonis said after searching for his registration, the officer stated, "’Next time you get pulled over by me, you have your hands on the wheel and look forward or I will put my gun to your head.’ "
"I felt threatened both times a Marlborough cop pulled me over," the teen stated.
In a phone interview yesterday, Pechonis said the July incident "wasn’t the first time and certainly wasn’t the last time I’ve been followed, pulled over or harassed for no reason."

"They (the police) see a group of kids in the car at night and think they have all this authority in the world," he said. "They try to scare kids. They think if I’m out late at night, I’m causing trouble."

He said when he received the letter, he asked police what Gough’s discipline was, and he was told he could not have that information.

"I don’t think it was anything," Pechonis said.

Marlborough Police Chief Mark Leonard said yesterday he could not comment on an internal investigation.

Leonard said he had not seen the handwritten complaint, "but that doesn’t mean we never got it. But I couldn’t speak to that."

"It was an internal issue that was handled, as the letter states," Leonard said. "I can’t comment any further on that."

Marlborough Police Patrol Officers Association President Patrick Hogan said he could not comment on the matter. He said he has not seen the letter and did not have information on the incident or disciplinary action.

Who is the the real criminal, Marlborough Police Officer James Gough who with his hand on his service weapon, threatened to put his gun against a 19 year old head, or the Father who posted his complaint about his actions on a web site.

This nightmare for Mr. Paul Pechonis began with a traffic stop of his nineteen year old son Jared.  On July 8, 2005 at 2:00 am, Jared was stopped by Marlborough police officer James P. Gough.  During this traffic stop Officer Gough became aggressive and domineering, threatening young Jared with  "next time I pull you over you better have two hands on the wheel and be facing forward or I'll put my gun to your head."  All while Officer Gough has his hand on his gun. No written traffic citation was issued during this traffic stop.

A citizen complaint was filed with the Marlborough Police Department.  On August 11, 2005 Captain Timothy J. Naze, Operational Division Commander sent a letter to Mr. Jared Pechonis, stating that the investigation revealed that the actions of Officer Gough violated departmental rules and regulations.  He would be subject to appropriated discipline under agency procedures.

Mr. Pechonis tried on several occasions to gain an understanding of appropriate discipline.  Mr. Pechonis was told appropriated discipline was privileged information and not available for public release.

On August 26, 2005 Mr. Pechonis emailed Marlborough Chief of Police Mark F. Leonord, asking Chief Leonord for a resolution to the issues of privileged information, relating to the discipline of Officer Gough.

August 30, 2005, Chief Leonord emailed Mr. Pechonis back.  Chief Leonord ignored the subject of privileged information, and instead ask for a written complaint with witness statements, then he would have the issue investigated involving Officer Gough.

The Marlborough police called Mr. Pechonis to come to the police station and talk about the web site Bonuskill.com.  Mr. Pechonis met with Captain Paul Valianti and Captain Timothy Naze. At the request of the police the conversation was recorded.  Mr. Pechonis states he was questioned as to his ability to create a web page, and if he was the author of the web page which mentioned Officer Gough.

On September 9, 2005 Mr. Pechonis was the subject of a poster investigation which brought him original notoriety.  State Trooper Nicholas Nason's State Police report begins on September 12, 2005.  Entry 11 states on September 20, 2005 an administrative subpoena was submitted. Entry 12 states preliminary investigation revealed the author to be Mr. Pechonis.  Entry 13, 14, 15 are dated September 26, yet the State police report contains no reported communication with with the Marlborough police.  

On November 11, 2005, Mr. Pechonis received an application for criminal complaint from Marlborough district court, for the offense of MGL 275/2, threat to Commit Crime, offense date, September 13, 2005. A probable cause hearing on this complaint is scheduled for December 8, 2005.  The complainants name is Captain Paul Valianti, who is listed on the Marlborough Police Department, as Services Division Commander – Internal Affairs.

Mr. Pechonis deserved the effort of Chief Leonord to look into the case and then return an informed and accurate reply.  Chief Leonard needs to act professionally and with dignity towards those who have been victimized by one of his Police Officers. 

Public disclosure can only be a positive outcome, secrecy only leads to distrust. Police brow beating and uninformed replies are the underlying factors surrounding this case.

The failure of dealing with a citizen complaint, which was already determined a violation of Marlborough Police policy has resulted in a Father being arrested for threats to commit a crime. 

Officer Gough who while issuing threats containing unauthorized use of his weapon along with derogatory comments about driving in his town, with his hand on his gun in the presence of young adults is not criminally charged.

Who is more the threat, a live individual with bullets and a gun or a photo and words on the internet? 

Young Jared after filing the citizen complaint found himself being subjected a very questionable charge of opening cars doors, Jared was held on a high bail of $500 dollars.

Mr. Pechonis has already been charged in Worcester district court for threats to commit a crime, for this same web site. This continued political prosecutions only clogs the courts time.

Worcester ADA Harold Johnson has of yet to produce any evidence associated with the last charges.

Who is Worcester District Attorney John Conte protecting by issuing a State Police C-Pac investigation and then criminal charges?

Certainly not those who are subject to the actions of Marlborough Police Officer James P. Gough. Nor citizens who file internal affairs complaints with a Police Departments.

A criminal application against Police Officer James P. Gough, for threat to commit a crime, will be filed in Marlborough District court this week.

September 2, 2005, Mr. Christopher Rucho registered through GoDaddy.com. the web site called Early2006.com. 

Mr. Joseph Early Jr. is reported to be a leading democratic candidate for the up coming 2006 election for the Worcester District Attorney's Office, according to Worcester Magazine.

The registrant of Early2006.com, Associate Court Officer Rucho, was involved in the recent web threat case September 9, 2005, in which Mr. Paul Pechonis was arrested for allegedly placing a photo with his website address listed in the Westborough district court.

Officer Rucho also owns other web sites such as Rucho.com, registered with GoDaddy.com. The Rucho site list Chris Rucho, as registrant along with a company named C.A. Rucho & sons Web Design.  The early2006 web site additionally list C.A. Rucho & sons Web Design as the administrative contact.

C.A. Rucho & sons web design has designed web sites for State Representative Jim Leary as well as Northborough Attorney Richard P. Dustin. 

Westborough District Court has jurisdiction of Grafton, Northborough, Shrewsbury, Southborough, and Westborough.

According to State Police Detective, Trooper Nichols E. Nason, Associate Court Officer, Stephen Garvais observed a white male bringing into Westborough district courthouse the alleged baby photo, than later noticed that same photo, now containing wording on the bulletin board in Westborough district court.  Trooper Nason's report does not record any review of the entrance video of the Westborough Courthouse.

According to a Westborough trial court incident report dated September 9, 2005, it was, Officer Rucho, who takes control of the alleged photo and investigated the website listed on the alleged photo, which is also registered with GoDaddy.com.  Officer Rucho's report includes a copy of the web page in question, and the alleged photo to his supervisor, Ms Robin Yancy, Regional Director of Security, Worcester. Ms Yancy's office is located in the Worcester Superior Courthouse building, 2 Main Street room 202.

According to section 7, page 4 of Trooper Nason report #2005-115-0476. both himself and Trooper John M. Caron interviewed Judge Paul S. Waisckowski in Westborough District Court on September 9, 2005, to which Trooper Nason records that Judge Waisckowski reported the web site caused him fear and concern regarding the language.  

According to the opening paragraph of Trooper Nason report, it states on Monday September 12, 2005 Captain Thomas Greene informed the undersigned and trooper John M. Caron of two sites listed on the internet. It ends with an investigation into the specifics of the website and the identity of the author of the web site was initiated.

On Page 7 of report #2005-115-0476 which list, a Statement of Judge Waisckowski, it is clearly dated September 12, 2005 at 3:58pm that the Troopers questioned Judge Waisckowski.

What paragraph in Trooper Nason's report is correct, If Trooper Nason was not assigned the investigation until September 12, 2005, how could he have interviewed Judge Waisckowski on the 9th in Westborough District Court?

Further the web page in Trooper Nason's report is dated on September 12, 2005, so it can not be the original printed page supplied to Ms Yancy, by officer Rucho, as the Westborough trial court incident report which states a copy of the web page was included is dated September 9, 2005.

Trooper Nason declares secured custody of the alleged photo on September 26, 2005. Trooper Nason asserts that the photo had been being held in the custody of Westborough district court officers. Trooper Nason's report does not detail any fingerprint evidence being taken from the alleged photo, nor a visual identification by Associate Court Officer Garvais of the alleged photo he took custody of on the 26th.

Trooper Nason's report does not included the relationship between Associate Court Officer Rucho and GoDaddy.com. Nor does Trooper Nason identify Officer Rucho's ability to produce and edit a web site or photo.

Trooper Nason's report, fails to show any investigation by the Trooper into the fact that Mr. Pechonis had denied knowledge of the alleged photo in their phone conversation days previous to his arrest.

November 2, 2005, during a pre-trial conference for Mr. Paul Pechonis, in Worcester District Court, for the alleged web threat. Assistant district attorney Harold "Harry" Johnson, did not produce any individual who witnessed Mr. Pechonis placing the alleged photo on the bulletin board, evidence of fingerprints or the entrance tape demonstrating Mr. Pechonis carrying in the alleged photo containing wording into Westborough district court on September 9, 2005.

Mr. Pechonis had been informed previous to September that many law enforcement personnel had viewed his web address and it was  listed on a secret password protected for law officials only chat room board.

Mr. Pechonis responded on September 9, 2005 to a request to go to Westborough District court to pay a previously unknown, outstanding $8.00 balance to the court for his son, to avert an arrest warrant being issued at the conclusion of the day.

Every entry and exit way in all District Courts in Massachusetts are monitored by a close circuit camera system, recording tape  according to Ms Robin Yancy, Regional Director of Security.

Mr. Paul Pechois has continued to deny ever seeing the photo of the alleged baby nor knowledge of its presence in Westborough District court.

No evidence has been provided placing Mr. Pechonis as the maker of the alleged photo in question, physical evidence on the photo, nor actual witness, of the delivery of the photo on the bulletin board. 

At the very best, this case of contradicting details, only further illustrates the common complaint of those inflected by "questionable" tactics conducted by Worcester District Attorney John Conte's Office, and his C-Pac State Police unit of a predetermined controlled outcomes to investigations.

Almost anyone, especially someone who designs web pages can electronically capture a web page, alter and reconstruct a new page version, then print.

If application of the criminal complaint "threat to commit a crime" was based on the discovery of the photo, as delivery of the "intent", under the "reasonable" doubt standard this case does not meet prosecutorial merit.

Web threat case hangs on poster brought to court house.  Defendant denies ever seeing poster before.

Web threat case investigated by Conte C-Pac State Police unit appears to be tied into a poster, that initiated the filing of criminal charges. Worcester Assistant District Attorney, Harold E. Johnson stated the placing of the poster in Westborough court was how the threat was allegedly delivered. The poster was allegedly found in Westborough district Court, by Associate Court Officer, Stephen Garvais. 

According to Trooper Nichols E. Nason in his Massachusetts State police detective Unit -Worcester report, Investigation into Death threats made against Judge Paul S. Waisckowski of Westborough District Court, case #2005-115-0476. On Friday September 9, 2005, court office Gervais was monitoring individuals that were entering and exiting the Westborough District Court. sometime during the morning on September 9, 2005 Office Gervais observed a white male individual enter the court house with a 8 X10  color photo of an infant's face.  Officer Garvis did not observe any writing on the picture as passed thought security.

In review of the poster it is hard to understand how the wording which is type set in large bold print could not have been noticed.

It was later according to Trooper Nason's report, that afternoon, Officer Gervais was monitoring the front entrance and lobby of the court house when he observed that picture of the infant posted on a bulletin board which is located in the lobby adjacent to the clerk's office.  Officer Gervais then observed that the picture had writing underneath the head of the infant, the text on the picture reads "Judge Paul Waiskowski is slowly starving my baby to death"

In a Massachusetts Trial Court-Security Department Incident Report dated September 9, 2005 at 2:30 pm Ms Robin Yancy, Regional Director of Security, Region II Worcester Massachusetts was contacted.  Ms Yancy received a fax from Associate Court Officer Christopher Rucho, who reported that officer Gervais has found the poster on a board in the main lobby.  Ms Yancy informed court officer Rucho that the State police were notified, and they would look into it.

The Trial Court-Security incident report fails to note the claim by Trooper Nason that the photo had been originally observed upon entrance in to the court house by Associate Court Officer, Stephen Gervais.  As all entrance an exits are monitored by close circuit cameras, this film will determine who actually brought the photo of the infant into Westborough district court.  Officer Gervais, description of a white male contains no details or identifying marks in reference to Mr. Paul Pechonis who was arrested on September 30, 2005 for a misdemeanor change of threatening to commit a crime. MGL section 275-2 according to trooper Nason.

Trooper Nason report states in section 15 of his report. Since the threats pose an imminent threat of harm to the Judge and Police Officers, the undersigned is requesting the warrant be issued forthwith. In phone conversation with Mr. Pechonis, on Thursday night on or about 7:30 pm when asked if Trooper Nason had an arrest warrant, trooper Nason replied "no" according to Mr. Pechonis.  These documents illustrate, Trooper Nason had ever intention of arresting Mr. Pechonis.

Teenage relatives of Mr. Pechonis were pulled over on two consecutive days last week by Massachusetts State Troopers in marked police vehicles. The vehicle being pulled over has been at the Pechonis residence on a regular bases.

Wednesday October 26, 2005, a State Trooper, pulls over the vehicle, the Trooper approaches the vehicle and states "I smell marijuana" the drive replies," I don't smoke sir", The trooper then requested license and registration.  The Trooper then states, "please step of of the car for me" the driver obliged, and was placed in the back of the State Police Vehicle.  The Trooper then went to the female passenger, after having her step out of the car, the Trooper requested,  "pull your shirt tight for me so I can see your waist, The trooper then requested the female to turn around.  After the Trooper looks in her jacket pockets he sends her to the State Police vehicle with the driver. The car  was searched, and all the contents of the vehicle was thrown along the roadway on the ground.  No motor vehicle violation was issued. The occupants were eventually allowed to gather belongings and drive away.

Thursday October 27, 2005 the same vehicle, same driver was pulled over.  This time the Trooper approaches the drives side and ask "have you been drinking"? The answer is no. The Trooper replies, "you expect me to believe that"? The Trooper then request license and registration, removes driver to the sidewalk, The Trooper, ask again "are you drinking"? "where are you coming from"? The Trooper than goes to vehicle passengers and states "I smell alcohol" They reply they have not been drinking. The Trooper than instructs the driver to return to the car. The trooper goes to his State Police Vehicle. The Trooper after some time returns to the car, returns license and registration and states "slow down".

Any other attempt to conduct unwarranted vehicle stops on these individual will be reported swiftly to the Commanding Officer of the Holden State Police barracks, and then forwarded to Captain Francis Moore, head of the internal affairs division of the Massachusetts State police.

Mr. Pechonis is scheduled to return to Worcester District court on November 2, 2005 for a pre trial conference.

Worcester C-Pac State police caught by baby cam during arrest.  Search conducted without showing of warrant.   Conte's Troopers exposed for deceitful tactics. C-Pac's Friday afternoon arrest in order to hold defended over weekend fails.

In Worcester County under the direction of John J Conte, District Attorney who has been in office for 29 years the Constitution of the United States need not apply.

Massachusetts State Police C-Pac Troopers under the command of Captain Thomas G. Greene are exposed in an over zealous reaction, searching a home without a warrant, and making implication knowing false by the arresting State Trooper Nichols Nason badge #2900, and Sergeant Francis Leahy.

At the bottom of Massachusetts State Police Auburn C-Pac letterhead reads, Excellence in Service thorough Quality Policing."  After viewing this video it appears more like Gestapo tactics, with falsified information for political reasons. Acts most America's believe occur in Russia or Bolivia.

Trooper Neson called Mr. Pechonis on Thursday night at 7:30 pm asking him to meet with him on Friday.  Mr. Pechonis stated he would be available Friday morning at 9:30 am.  Mr. Pechonis asked how long this would take, Trooper Nason, replied about 1 hour.  Mr. Pechois then asked Trooper Nason if he had an arrest warrant, Trooper Nason replied no.

On Thursday September 29, 2005 Trooper Nason wrote an eight (8) page report, addressed to C-Pac Commander Captain Thomas G. Greene badge#1126, subject: Investigation of death threats to Judge Waickowski.  This report was used to generate the arrest warrant issued.

Friday September 30, 2005 at 9:30 am the phone rings and Trooper Nason states there has been a sudden death.  Mr. Pechonis ask if this can wait until next week. Trooper Nason states no. Mr. Pechonis agrees to meet the Trooper at his home at 1 o'clock.

A total of twelve Massachusetts State Police cars were observed pulling into Mr. Pechonis residence at 1pm.

The C-Pac State Troopers arrive at the door with handshakes and greetings.  Three unarmed individuals are standing in their home.

When Mr. Pechonis ask what he is being arrested for, Trooper Nicholas Nason  replies "this is a misdemeanor warrant, threats to commit a crime".  

One must wonder how many misdemeanor warrants are issued in this fashion by this C-Pac Unit. District Attorney John J. Conte represents this Units purpose as investigation of major crimes in Worcester County.

At 57 seconds into the tape, Sergeant Francis Leahy after getting a Nextel page reports "ok Tom". (Captain Thomas G. Greene)

Sergeant Francis Leahy states "once everything is on we will explain everything to you". Mr. Pechonis replies "ok". "Can't talk",  exclaims Trooper Nason. The sound of handcuffs clicking can be heard.

Sergeant Leahy then announces, "ladies we are going to explain everything to you, no need to get nervous, or excited we are gong to the court house and get you arraigned, and then it is up to the clerk and he'll be back in a hour.  (lie #1)

No search warrant is ever presented to Mr. Pechonis, his wife or his Mother who all witness the arrest.

Sergeant Leahy then ask, is there anyone else in the house right now?  Mrs. Pechonis and her husband reply the baby is sleeping, Sergeant Leahy replies "ok"

Sergeant Leahy then states, "what we are going to do because there were weapon involved. We are going to make sure nobody else that poses a danger to anyone here, then we will be out of here". (lie#2) 

At this point Sergeant Leahy commands other State Troopers, who were waiting outside to "come on, bring it in hear". 

Sergeant Leahy yells" Hello this is the police, we are not going to bother your baby." as he walks throughout the first floor of the house.

Seven (7) Massachusetts State Troopers in plain cloths attached to Worcester DA John Conte's office, and one Northbro Police officer are seen walking thought the house.  The Troopers have their hands in their pockets and heads down wondering around aimlessly looking in circles, one following the other. 

At 2 minutes 25 seconds into the tape Trooper Nason reads Mr. Peconis his Miranda rights.

When Mr. Pechonis tells his mother, you have the cash, you have to come with us,  Trooper Nason immediately states " what this is hear is a misdemeanor warrant, not a felony warrant so the chance of you being held over the weekend or anything like that is probably not goanna happen". (lie#3)

Mr. Pechonis ask again what am I being arrested for, Trooper Nason replies " misdemeanor threats to commit a crime, for language that was on the intent site in regards what you said about Judge Waickowski." (lie #4)

The alleged threat was brought to the attention of Judge Waickowski September 9, 2005, who claimed that the website caused him fear and concern over the language  Mr. Pechonis was arrested on September 30, 2005 some 21 days later.

As we know Worcester Assistant District Attorney, Harold Johnson tried to have Mr. Pechonis committed for a mental observation over the weekend.  When  Worcester Judge David P. Despotopulos refused,  Mr. Johnson requested bail to be set at $20,000. Judge Despotopulos denied the request and set bail for Mr. Pechonis at $5,000 cash. Mrs. Pechonis posted bail as she had gone to the court to see the arraignment.

One must wonder if telling the truth is part of State Police training.  During the arrest Massachusetts State Troopers made four (4) knowing false statements within a mater of five minutes.

Mr. Pechonis already suspicious of the circumstance was prepared with bail money knowing of the Conte's, C-Pac State Police late Friday afternoon arrangement trick.

Threat suspect passes evaluation - Man deemed fit to stand trial

WORCESTER - A Northboro man accused of threatening a judge was determined to be mentally competent to stand trial after undergoing a court-ordered preliminary psychiatric evaluation yesterday.

Paul Pechonis, 46, of 17 Milk Porridge Drive, Northboro, was arraigned Friday in Westboro District Court on a charge of threatening to murder the court's presiding justice, Paul S. Waickowski. Mr. Pechonis is alleged to have called for Judge Waickowski's "resignation or execution" on a Web site he helped create.

The Web site and alleged threat came to the attention of state police after a poster bearing a photo of Mr. Pechonis' child and a claim that Judge Waickowski "is slowly starving my baby to death" appeared Sept. 9 on a bulletin board in a hallway at the Westboro courthouse. The poster also listed the address of one of the two Web sites investigators said they traced to Mr. Pechonis.

Mr. Pechonis was released on $5,000 cash bail, and his case was continued to yesterday in Central District Court. At the request of Assistant District Attorney Harold E. Johnson, Judge Robert L. Howarth ordered Mr. Pechonis to undergo yesterday's preliminary competency examination. Paul Bail, the forensic psychologist who conducted the evaluation, later testified that Mr. Pechonis reported no history of mental illness and appeared mentally competent to stand trial.

Mr. Bail said Mr. Pechonis seemed to have a thorough understanding of the court process and the charge against him and was able to communicate intelligently with his lawyers, Peter E. Padula and Darius A. Arbabi.

Mr. Padula had objected to the evaluation, calling it "totally unwarranted."

Mr. Johnson had said he felt the competency question needed to be addressed given the nature of the allegations against Mr. Pechonis. When interviewed by state police, Mr. Pechonis admitted being one of the "authors" of the Web site in question, but denied using threatening language or placing the poster on the courthouse bulletin board, the prosecutor said.

One of the Web sites makes references to a civil hearing in Westboro District Court in which Mr. Pechonis' paycheck was garnisheed for money owed to a credit card account, according to court records. Although Mr. Pechonis allegedly blamed Judge Waickowski for the order, state police investigators found it was actually Judge Vito A. Virzi who presided over the case, the records show. The name of the Web site included the name of Howard Lee Schiff, the lawyer for the credit card company.

One of the Web sites to which Mr. Pechonis was linked by investigators has a page entitled "Death to Pig Gough," an apparent reference to Marlboro Police Officer James P. Gough.

Judge Howarth released Mr. Pechonis yesterday on the previously posted $5,000 cash bail and continued his case to Nov. 2. At Mr. Johnson's request, the judge ordered Mr. Pechonis to have no contact with Judge Waickowski, Judge Virzi, Mr. Schiff and Officer Gough.

Man charged in Web threats

WESTBORO— A Northboro man who allegedly asked for the “resignation or execution” of Westboro District Court Judge Paul S. Waickowski on one of the Web sites he created was charged in court yesterday with threatening to commit a crime (murder).

Paul Pechonis, 46, of 17 Milk Porridge Drive, Northboro, also claimed the judge “is slowly starving my baby to death” and allegedly placed a poster of his child and that statement on a bulletin board in the Westboro District Court hallway Sept. 9, according to court records.

Mr. Pechonis’ lawyer for yesterday’s arraignment, Scott Davis, said there are issues with First Amendment rights in the case and also contended the threat was never conveyed directly to the judge. He said there is a question of whether the Web sites could be directly linked to Mr. Pechonis.

Assistant District Attorney Harold E. Johnson said when Mr. Pechonis placed the poster of his child with the statement and the address for one of his Web sites at the courthouse the threat was then communicated to Judge Waickowski.

Mr. Pechonis allegedly posted on the Web site
www.howardleeschiffpredators.com information about a civil hearing in Westboro District Court in which a judge ordered to have Mr. Pechonis’ paycheck garnisheed for money owed to a Discover Card account, court records said. The lawyer for Discover Credit Card was from the offices of attorney Howard Lee Schiff, court records said.

“The author states that $125 is being deducted from his paycheck, thus starving his baby to death,” court records said. “The author then states that it was Judge Paul S. Waickowski that has allowed this civil action to take place.”

The troopers found it was actually Judge Vito A. Virzi who presided over the civil hearing, records said. Mr. Pechonis was not at the hearing, records said.

Court records allege Mr. Pechonis has two Web sites,
www.bonuskill.com and www.howardleeschiffpredators.com, and it was on those sites he threatened Judge Waickowski. State troopers assigned to Worcester District Attorney John J. Conte’s office said in court records they traced both Web sites back to Mr. Pechonis. The Web site www.bonuskill.com also has a section about Peter H. Pechonis, who died in 2000. Obituaries list him as Mr. Pechonis’ brother.

One of the Web sites also has a page titled, “Death to Pig Gough” and there is a picture of a man holding and pointing a shotgun, sword, revolver and a handgun at the camera. The title is in reference to Marlboro Police Officer James P. Gough. According to court records, Mr. Pechonis said his son had an incident with Marlboro police.

Mr. Pechonis discusses the loss of freedom in the United States on
www.bonuskill.com and even says he understood state, local and federal law enforcement officials have “taken an interest in my opinions.”

“Since when is it a crime to voice one’s opinion?” the Web site asks. “The views expressed on this site are a collaboration of thoughts from many freedom loving individuals.”

The Web site also says the site was not designed to threaten people. A recent post on the Web site also says, “the state police are in my house interrogating me about my opinions. I will try to keep this updated unless they silence (assassinate) me.” State police arrested Mr. Pechonis yesterday.

The Web sites, which officials said were created by Mr. Pechonis, also have pictures of his family and post portions of the Bill of Rights.

Westboro District Court Associate Court Officer Stephen Gervais noticed the poster, allegedly placed at the courthouse by Mr. Pechonis, on Sept. 9, court records said. Court Officer Christopher Russo checked out the Web site listed on the poster and made authorities aware of its contents, according to court records.

“I NEVER HAD MY DAY IN COURT,” Mr. Pechonis wrote on one of the Web sites. “Just so you know, that leaves me with $0 per week, before I have to pay child support, rent, food, utilities, you know all the things you need to live.” It further says, “I hope god strikes him dead for his crimes against humanity,” in a reference to Judge Waickowski.

Troopers spoke with Judge Waickowski Sept. 9 and he told the investigators he was aware of the Web site, records said.

“Judge Waickowski stated that the website caused him fear and concern over the language in
www.howardleeschiffpredators.com,” court records said. “Judge Waickowski stated that he became concerned when the website called for his resignation or execution.”

Judge David P. Despotopulos was brought in from Worcester to handle Mr. Pechonis’ arraignment yesterday. Assistant District Attorney Johnson wanted Mr. Pechonis held until Monday so a competency and responsibility hearing could be held, but if the judge decided against that request, Mr. Johnson wanted bail set at $20,000. The judge denied the request and set bail for Mr. Pechonis at $5,000 cash. Mr. Pechonis’ family was in the courtroom yesterday and posted the bail after the arraignment.

Mr. Pechonis was ordered to stay away from Judge Waickowski and Officer Gough. His case was continued to Monday, but was transferred to Worcester Central District Court.

A self-employed contractor, Mr. Pechonis had a three-page criminal record, but Mr. Davis pointed out the charges were mostly motor vehicle violations and larceny charges.

Mr. Pechonis also wrote on one of the Web sites that Judge Waickowski placed his son on $500 cash bail when he was charged with allegedly opening car doors in Northboro while he was with some friends. He then insults the judge and an assistant district attorney.
