  Clergy Abuse Plea Deals Bar-Jonah A. Jennings

 

It appears that who you are plays a major role is how justice in served from the office of District Attorney John J. Conte. This is certainly true of who is prosecuted for sexual abuse and rape of children.

For instance, a teacher from Shepherd Hill High School got what appears to be a sweetheart deal after she was criminally charged with sexually abusing one of her male students. She was given only probation.

Let's contrast the case of Amber Jennings with what happened to Beth Geisel, a teacher in the Albany, N.Y. area, who was charged criminally with having sex with a 16-year-old student. She was sentenced to six months in jail by an Albany judge.

Security video from Geoghan slay hits Web

State correction officials are investigating whether the killer convicted of strangling and stomping a pedophile priest posted a security surveillance video on YouTube showing prison guards desperately trying to pry open cell doors as the murder took place.  

The Herald was alerted to the posting yesterday in a handwritten note purportedly written by Joseph Druce, who was convicted of first-degree murder in the Aug. 23, 2003, slaying of 68-year-old John Geoghan.

“The truth about officer involvement in John Geogan’s (sic) death,” the taunting note says, directing the reader to www.youtube.com/Joseph Druce. “The truth about officers allowing J.G. to die through their neglect.”  

The 10-minute video was posted June 12 under the heading “the first of many.” It shows a gaggle of correction officers at the Souza-Baranowski Correctional Center pulling at the cell doors of Druce’s cell.

In 2005, the Herald obtained a security video that showed Druce coldly pantomiming Geoghan’s murder - a tape that showed how he used a paperback book to jam the sliding cell doors.

Man willingly left Leominster police in 2004


WORCESTER— A former Leominster police officer, who left his job in 2004, was arraigned yesterday on charges he sexually assaulted an 11-year-old girl in Leominster.

William R. Coulter, 51, of 18 Manchester St., Leominster, was arrested by state police Monday, after troopers investigated reports that a girl was assaulted by the former officer.

Assistant District Attorney Jeffrey T. Travers said the assaults were alleged to have occurred during the past year. Court records report that the assaults were in Leominster.

The 11-year-old told state police that on several occasions, Mr. Coulter made her touch his genitals and perform sex acts on him, according to reports on file in Central District Court.

Ex-chief's lawyer: We're going to trial 

GARDNER -- A district court judge has denied a motion to dismiss a charge of sexual assault filed in March against Mount Wachusett Community College's former campus police chief.

The attorney for the former chief, Robert E. Mackie, 40, of Winchendon, who faces one count of indecent assault and battery, said Friday he and his client are now preparing for a trial.

"We're absolutely going to trial," Mackie's lawyer, John A. Mizhir of Winchendon, said in a telephone interview. "I don't have any choice, do I?"

N. Brookfield firefighter faces child porn charges 

NORTH BROOKFIELDA local firefighter has been placed on leave pending the outcome of a case in which he is charged with distributing child pornography and indecent assault and battery on someone under 14 years old.

John J. Zuidema, 39, of Downey Road, is being held on $10,000 bail after being arraigned in Western Worcester District Court in East Brookfield on several charges last month. He was in court this week and a pretrial conference is scheduled for June 19.

New child sex charges lodged

AUBURN— The former School Committee chairman is facing new charges that he sexually assaulted a minor.

Joseph F. Ferrie, 75, will be summoned to Central District Court in Worcester for an April 5 arraignment on two criminal complaints issued yesterday. Police Chief Andrew J. Sluckis Jr. said criminal complaints of indecent assault and battery on a child under 14 and rape of a child with force were issued in Central District Court against Mr. Ferrie, of 188 Rochdale St.

Sex case against fire captain dropped

EAST BROOKFIELD - A case involving the alleged indecent assault of a girl brought against Barre Fire Department Capt. Mark S. Clarkson last year was dismissed yesterday by request of the district attorney, the victim and the defendant.

"Despite the fact we have a videotape confession of Mr. Clarkson confessing to assaulting the victim, his confession went uncorroborated because the victim was unwilling to testify in court," Barre Police Chief John J. Manzi said. "The district attorney could not prosecute the case because the victim was unwilling to testify."

"The witness in this matter did not wish to proceed," Karen J. Foley, a spokeswoman for Worcester District Attorney John J. Conte, said yesterday.

In October, the court had issued a complaint against Capt. Clarkson, 49, of 213 North Brookfield Road, Barre, on two counts of indecent assault and battery upon a child under age 14. Barre police filed a complaint with the court Oct. 15, stating offenses allegedly occurred Sept. 27 and Oct. 11.

Capt. Clarkson has been a call firefighter captain with the Barre Fire Department for seven years. He has been a member of the department for more than 22 years.

Yesterday's order dismissing the case against Capt. Clarkson was signed by Judge Charles A. Abdella, the clerk's office said.

No jail for kiddie ‘predator’

State police and victims’ parents are fuming that a Worcester judge refused to send a “most wanted” serial child rapist back to prison for fleeing to Florida and repeatedly violating his probation.  

Worcester Superior Court Judge John McCann put Winchendon child molester Glen Wheeler on 10 years’ probation and an electronic monitoring bracelet - even though the 56-year-old con has racked up 11 probation violations, has an alias and went on the run for eight months before being tracked down at a Tampa, Fla., mosque. Wheeler was on the state police list of “most wanted high-risk sex offenders.”

Long-sought rape suspect ordered held without bail

WORCESTER— A rape and kidnapping suspect who jumped bail more than 16 years ago was ordered held without bail yesterday.

Donald J. Comerford, 39, formerly of Dudley, was back in Worcester Superior Court yesterday, where he is facing aggravated rape, indecent assault and battery, assault and kidnapping charges stemming from a series of sexual assaults he is accused of committing in 1988. Mr. Comerford was returned to Massachusetts after being arrested Nov. 8 in Texas, where he was stopped for a motor vehicle violation.

Rape suspect to be extradited
Fugitive fled Dudley for Texas


A former Dudley resident, arrested in November in Texas after he fled this state 16 years ago on charges of rape and assault involving a dozen area women, is to return to Massachusetts.

Worcester District Attorney John J. Conte said in a press release yesterday that Donald J. Comerford, 39, fought extradition proceedings in Texas but after a hearing in the 319th District Court in Corpus Christi, Judge Thomas Greenwell ordered that Mr. Comerford be returned to Massachusetts........

Mr. Comerford was arrested in Worcester Oct. 18, 1988, after a teacher chased him from Doherty Memorial High School. He was being sought in connection with three attacks that day on women in the city's West Side. Mr. Comerford was freed on $106,000 bail posted in October 1988 by his father, James Comerford, then a state police trooper.

Victims’ rights group troubled by kiss-off

Kiss-offs come in many forms but they’re still kiss-offs, even if they’re unstintingly polite and bear the seal of the Worcester district attorney.
In January, VictimPower sent a complaint of sexual abuse at an area church to District Attorney John J. Conte. Mr. Conte has since claimed that he never told VictimPower that he wouldn’t accept anonymous reports. But perhaps we should let the letter from his office to VictimPower speak for itself:

“While this office appreciates your trying to assist us in prosecuting such cases, you should be aware that anonymous reports are of little if any help,” wrote Assistant District Attorney Christopher P. Hodgens on Feb. 7. “Courts do not allow us to prosecute cases with anonymous victims … Your support of victims is admirable. The District Attorney’s Office urges you to encourage all victims to speak directly with law enforcement agencies.”

In others words: Get lost. Thanks, but no thanks. When it comes to new and novel approaches to fight crime that threaten his sacred turf, our district attorney takes a pass

Conte called unwilling to take abuse reports
Web site allows victims to talk anonymously

The co-founder of VictimPower.org, a Web site created to ease the process for victims of sexual abuse to report the crimes, yesterday accused Worcester District Attorney John J. Conte of not cooperating with the effort.

Mr. Galebach and Mr. Conte both provided copies of a Feb. 7 letter written to VictimPower by Assistant Worcester District Attorney Christopher P. Hodgens, which states that “anonymous reports are of little if any help.” He pointed out that courts do not allow cases involving anonymous victims to be prosecuted.

Plea lets officer get wrist slap
Choice of the charge was an indecency, too

It's a pet peeve of police, the way criminals they've worked hard to arrest end up with a slap on the wrist from the courts.

But when the alleged criminal is also a cop, such incidents are particularly galling. Especially when you consider the case of Worcester Police Sgt. Paul Ohman, who remains on the city payroll and has largely managed to avoid any real consequences of his illegal and appalling behavior.

As a result, Judge Austin T. Philbin placed the 10-year police veteran on pretrial probation, despite a recommendation from Assistant District Attorney Joseph J. Reilly III that Sgt. Ohman be found guilty and that he resign from the Police Department as a condition of probation. Instead, Judge Philbin left the sergeant's career up to police, and the charges will be dismissed in 18 months if Sgt. Ohman has no further difficulties with the law.
