Federal restraining order violation sought in scam interview regarding clergy sexual abuse case.
On September 21, 2007 newly elected District Attorney Joseph Early Jr. claimed he had "something in mind" in regards to what many believe has been a fake presentation of a incompetence claim in Worcester District Court criminal case Commonwealth v John Szantyr.
Fr John Szantyr has been charged since 2003 with four counts of indecent assault and battery on a child under fourteen. Fr John Szantyr is facing two different alleged victims whose criminal cases have been conjoined.
District Attorney Joseph Early was informed on August 20, 2007 by individuals who stood in front of him that the alleged sexual abuse spanned a thirty year time frame.
On October 2, 2007 under the belief that the state police were actually going to conduct an investigation of the evidence that had been supplied to the DA's office regarding Fr John Szantyr, "which demonstrated he was indeed competent", the State police instead initiated a last ditch effort to entrap Mary Jean in regards to her Federal case Jean v Massachusetts State police.
Massachusetts State Trooper, David Cravedi who conducted the interview in which he claims was scheduled for only two reasons: to gain facts in regards to the competency issues and threats made on the behalf of Fr John Szantyr. Trooper Cravedi actually spent very little time asking questions regarding those issues and instead used the interview as a fact finding mission regarding the Federal video case posting.
A CD of the audio from the interview was provided after a request to District Attorney Early who was informed that questions regarding the Federal case and restraining order were included in the interview.
Locked inside the Massachusetts Leominster State police barrack, Ms Jean felt threatened and intimidated when unexpected questions were imposed on her in regards to her restraining order while a digital tape recorder was running.
The questions began with "do you run any other web sites"? This question had nothing to do with the issues at hand. Trooper Cravedi was informed of the conte2006.com web site and the current federal restraining order.
With full knowledge of the restraining order, Trooper Cravedi returns four minutes after a change in the subject to ask such questions as, "how do you feel, is it necessary going back to the restraining order?" "Is there a need for the restraining order to continue, have you been threatened?"
None of these questions are appropriate and appear to be a clear violation of the restraining order.
A CD of the interview was provided by State Trooper David Cravedi and Trooper Daniel Richard on October 16, 2007 at the Leominster State police barracks.
When the video was played for the first time on October 22, 2007 it was determined that the audio stopped in the middle of a sentence in regards to the amicus brief concerning the Szantyr case.
Worcester DA Joseph Early's office was contacted on October 23, 2007 under the assumption that this was no more than an accidental recording error. Paralegal assistant Jennifer Nadeau was informed of the missing audio. She stated she would bring it to the DA's attention.
Lt. Richard McKeon, Auburn C-Pac commander called Ms Jean at 3.21pm regarding the missing audio. Lt McKeon ask Ms Jean if she was "willing to admit she was wrong". He admitted he did not participate in the interview nor the CD recording. He further exclaimed "we did not have to give you a copy of the interview".
I explained to Lt McKeon if I was not provided a complete version of the interview, that I would have to bring this to the attention of the judge.
Lt McKeon's actions also illustrate a violation of the restraining order because this phone call was in no way related to a criminal investigation. The only purpose of his phone call was to intimidate me in regards to my request for gaining a full audio version of the October 2, 2007 interview.
On January 17, 2008 by means of the use of restoration audio software the missing 15 minutes plus of the audio was recovered.
